HİZMET AGREEMENT ARTICLE 1: PARTIES 1.1. AGENT (PROVIDER) Trade Name: ADT TİM TURİZM TİCARET LIMITED COMPANY (referred to as "TatilBizden" or "Agent" in the Agreement) Address: Ölüdeniz Mahallesi, Likya (Old) Caddesi No:16/2 Fethiye / Muğla Tax Office / No: Fethiye / 0081800431 MERSIS Number: 0008 1800 431 00001 TOURISM ASSOCIATION Certificate Number: 15428 Contact Information: 0537 790 29 03 / adttim@hotmail.com 1.2. CONSUMER (PARTICIPANT) An individual or legal entity who purchases tour packages, holiday packages, daily activities, or accommodation services through the Agent’s website or digital sales channels, or on whose behalf services are purchased. (referred to as "Consumer" in the Agreement) ARTICLE 2: SUBJECT OF THE CONTRACT The subject of this agreement; to determine the operational fulfillment conditions, mutual rights, obligations, and responsibilities of the Parties in accordance with Law No. 1618 on Travel Agencies and relevant tourism regulations, regarding the travel packages, holiday packages, and daily activities (paragliding, boat tour, jeep safari, etc.) purchased electronically by the Consumer through the Agent’s website. ARTICLE 3: RIGHTS AND OBLIGATIONS OF THE AGENT 3.1. Service Standards: The Agent is obliged to organize the purchased travel service in accordance with the content and standards specified on the promotional page and announced program on the website. 3.2. Operational Change Right: The Agent has the right to make changes of an equal level in the program flow, vehicles used, or accommodation facilities in case of operational necessities such as weather conditions, safety, sudden venue closures, strikes, or technical failures, to protect the comfort and safety of the Consumer. Such obligatory changes do not give the Consumer the right to terminate the contract or claim compensation. 3.3. Cancellation Due to Insufficient Participation: If the minimum number of participants required for the realization of tour packages is not met, the Agent has the right to cancel the tour. The participant must be notified at least 21 days (for abroad) or 7 days (for domestic) before the start date. In this case, the full amount paid by the Consumer will be refunded, and no additional compensation can be claimed. ARTICLE 4: RIGHTS AND OBLIGATIONS OF THE CONSUMER 4.1. Time Management and Delays (No-Show): The Consumer is obliged to strictly adhere to the meeting, departure, and activity times communicated to him/her. Failure to be present at the meeting point at the specified time results in loss of travel rights, and no refund will be made. Additional transportation and access costs incurred by the Consumer for late participation are entirely his/her responsibility. 4.2. Health Declaration and Physical Fitness: The Consumer expressly accepts, declares, and undertakes that his/her health condition (heart problems, blood pressure, panic attacks, epilepsy, pregnancy, etc.) is suitable for activities involving extreme sports and intensive physical activities (paragliding, diving, rafting, etc.). The Agent is not responsible for discomforts, injuries, or accidents resulting from health concealment or non-compliance with activity rules. 4.3. Luggage and Personal Items Responsibility: During the journey, the Consumer's personal belongings, valuables, documents, money, phones, and jewelry are entirely his/her responsibility. The Agent is not responsible for lost, stolen, or forgotten items. 4.4. Damages to Environment and Equipment: The Consumer is responsible for immediately compensating for any damages caused by his/her fault or negligence to third parties, the environment, transfer vehicles, boats, or safety/equipment provided (parachutes, helmets, life jackets, etc.). ARTICLE 5: INTERNATIONAL TRAVEL, PASSPORT, AND VISA PROCEDURES 5.1. If the purchased service includes international tours, the Consumer is responsible for possessing a valid, unstamped passport with at least 6 months validity from the travel date. 5.2. The Consumer is responsible for the complete and accurate visa application procedures according to the destination country’s visa policy. The Agency does not guarantee visa approval. The Agency is not responsible for non-issuance of visas, rejection, or entry bans at customs, and the contract shall be subject to the same terms for cancellation and penalties. ARTICLE 6: TRAVEL INSURANCE If the purchased service is within a Package Tour, the mandatory “Compulsory Travel Insurance” (covering agency insolvency or inability to fulfill obligations) required by Law No. 1618 is arranged by the Agent. For daily activities, local operational insurance policies and the insurer’s liability insurances apply. The Consumer may obtain additional travel health insurances, covering personal accidents, illnesses, or baggage loss, before travel at his/her own expense. ARTICLE 7: FORCE MAJEURE Natural disasters (earthquake, flood, landslide), adverse weather conditions (violent winds, storms) directly preventing paragliding flights or boat tours, war, acts of terrorism, strikes, pandemics, curfews, or official administrative decisions are considered force majeure. The Agency shall notify the Consumer immediately upon learning of the situation. The Consumer has the right to reschedule or request a refund. In case of cancellation, no additional compensation or loss of profits can be claimed by either Party. ARTICLE 8: JURISDICTION AND DURATION In case of disputes arising from and related to this agreement, the Consumer Arbitration Committees within the legal limits announced by the Ministry of Commerce and the Fethiye Courts and Enforcement Offices where the Agency is located are authorized. The Consumer is deemed to have read, understood, and accepted all the terms of this Service Agreement when completing the reservation and making the payment via the website.
