CANCELLATION AND RETURN CONDITIONS
ADT TİM TURİZM TİCARET LİMİTED ŞİRKETİ (TatilBizden) provides the cancellation, refund, and modification procedures related to the package tours, holiday packages, and daily activities purchased through us; in accordance with Law No. 6502 on the Protection of Consumers, the Distance Contracts Regulation, and the Package Tour Regulation, under the following terms.
1. LEGAL NOTICE ON THE RIGHT OF WITHDRAWAL (WARNING)
According to Article 15/1-g of the Distance Contracts Regulation; "In contracts related to leisure time activities for accommodation, transportation of goods, vehicle rental, food and beverage supply, and entertainment or recreation activities, which must be performed on a specific date or period" the consumer does not have the right to withdraw without cause or unconditional refund. As all tourism and travel services offered on our site fall under this scope, cancellations and refunds are only carried out within the following rules.
2. DAILY ACTIVITIES (Paragliding, Boat Tours, Safari, Diving, etc.)
- Up to 48 Hours Before Service Time: The consumer can cancel the purchased daily activities without penalty by notifying our company in writing (email or persistent data recorder) at least 48 hours before the start time of the service. In this case, the full amount paid will be refunded to the consumer’s card within 14 working days.
- Less Than 48 Hours Before Service Time: For cancellations made less than 48 hours before the activity start time or if the consumer is not present at the designated area at the activity time (No-Show), the service is considered fully executed, and no refund will be made.
3. DOMESTIC / INTERNATIONAL PACKAGE HOLIDAYS AND TOUR PACKAGES
- At Least 30 Days Before the Start of the Tour: If the consumer notifies us that they are unilaterally canceling the contract at least 30 days before the start of the tour; excluding taxes, fees, and similar legal obligations arising from the cancellation, as well as third-party non-refundable costs (such as non-refundable airline tickets, hotel prepayments, etc.), the paid amount will be fully refunded without any deduction.
- Between 30 and 14 Days Before the Tour Start: For cancellations made less than 30 days but more than 14 days before the start of the package, due to operational pre-reservation losses, 50% of the total service fee will be deducted as a cancellation penalty, and the remaining amount will be refunded to the consumer.
- 14 Days or Less Before the Tour Start: For cancellations or terminations made within 14 days or less before the start of the package, the full service fee (100%) is forfeited by TatilBizden; no refund will be provided to the consumer.
4. FORCE MAJEURE AND WEATHER-RELATED CANCELLATIONS
- Weather Conditions (Especially Paragliding and Boat Tours): Paragliding flights and boat tours are completely dependent on weather conditions (wind, wave, visibility). If authorized agencies (Civil Aviation, Port Authority, etc.) or our licensed pilots/captains decide that safety cannot be ensured due to weather, and as a result, the activity is canceled; initially, a date change to another suitable day/time is proposed to the consumer. If the consumer’s holiday duration is insufficient or the consumer does not accept the new date, the full fee will be refunded without delay.
- General Force Majeure: In cases where natural disasters (earthquake, flood), war, terrorist acts, strikes, pandemics, or official governmental bans make the conduct of tours or activities impossible; TatilBizden is obliged to refund the consumer or postpone the reservation. In such situations, neither party can claim additional compensation or lost profit from the other.
5. REFUND PROCESS AND TIMELINE
- Refunds for canceled reservations are directly processed by TatilBizden to the consumer’s credit card/debit card with a single instruction.
- After our company issues the refund instruction, the refund amount's reflection time may vary depending on the banks’ internal processing: 1-7 business days for credit cards and 7-14 business days for bank debit cards. The monitoring of this duration is between the consumer and the bank.
6. RESERVATION CHANGES AND ASSIGNMENT OF RIGHTS
- The consumer can request to change the date of travel or activity at least 48 hours in advance for daily activities and at least 7 days in advance for package tours, depending on operational suitability. Changes are made free of charge or with any applicable additional charges for hotel/transportation differences paid by the consumer, based on availability.
- If the consumer cannot continue with the package tour, they may transfer the reservation to a third party who fulfills all the conditions of the contract, provided that the transfer is communicated at least 7 days before the start of the tour. The transferee, along with the transferor, is jointly responsible for paying the remaining balance and any additional costs arising from the transfer.
